Investigation Report: FIPPA Refused Access – Manitoba Families

Summary

An individual made a request to Manitoba Families for access to information, correspondence and records related to service contracts and funding service agreements awarded to First Nations of Northern Manitoba Child and Family Service Authority and the First Nations of Southern Manitoba Child and Family Service Authority. The public body provided only partial access to the records, and we received a complaint about the decision to grant only partial access.

Our office investigated the complaint and found the public body did not fulfill its duty to assist the complainant and failed to release records related to the complainant’s access request. We also found the mandatory exceptions to disclosure, under section 17 of FIPPA, that the public body applied, did not apply to the withheld information.

Our office issued three recommendations including that the public body release all the requested information requested. The public body complied with the time limit to respond to our report and recommendations and accepted the recommendations.
