Investigation Report: FIPPA Refused Access – Manitoba Agriculture

Summary

An individual made an access request to Manitoba Agriculture for records about an investigation initiated under the Animal Care Act. The department refused access in full on the basis that disclosure would be harmful to a third party’s privacy and business interests. In the course of our investigation, the department issued a revised access decision stating that it was also refusing access on the basis that disclosure would be harmful to law enforcement or legal proceedings. Our office found that the department’s decision to refuse access was authorized under FIPPA. The complaint was not supported.
