Investigation Report: PHIA Collection, Use and Disclosure – Manitoba Public Insurance

Summary

An individual was involved in a motor vehicle accident that resulted in a claim against Manitoba Public Insurance (MPI) under the Personal Injury Insurance Plan. The individual believed that MPI had collected additional medical information about them without authorization. The Corporation assured the individual that the unauthorized information had been removed from their claim file. The individual later discovered that the information in question had been shared with the Automobile Compensation Appeal Commission. The ombudsman found that there had been an unauthorized collection of personal health information and subsequent unauthorized use and disclosure of the personal health information.
